Bankruptcy forms

Hi

I am doing a joint bankruptcy with my long term partner, when filling the forms in do we have to have separate forms for each person?

  • But can we both go in to see the judge together? Do we have to have separate OR interviews?

It depends upon how your local court works. With mine they didn't do specific appointments but you had to turn up at a designated "Bankruptcy hour" slot & wait to see the clerk. You can take someone into the clerks office with you. Then clerk goes through all the form checking for gaps or errors etc, & takes your fee. I didn't have to see a judge. Clerk takes form away & lets judge have a look see. I was told if judge wanted to see me in person then clerk would ring my mobile. Told come back in about 2 hrs. And then I got my Bankpty certificate. Though I got an INITIAL call from the OR quite quickly (within the hr) after that so ensure you are prepared.
So if going together & the above system operates in your court there shouldn't be a problem you both doing a "2 for 1" if you see what I mean! ;)
Also, with regard the OR you may not see in person. So could be 2 phone calls.
  • If you are struggling with the forms, you can always visit the NEDCAB site, where they can be downloaded, with an example of how to fill them in as well to give you some help with that side of it.

Don't forget they have to be filled out in triplicate, and can't (or shouldn't) be signed until you are actually at the court.
