    Sounds like a bit of a mess, to be honest. Have you considered calling Stepchange?

    You really need to get decent advice for your own particular circumstances.

    I'm no expert, but I can see some problems with what you're saying.

    First of all there will be a charging order for secured loans, so instead of both getting half one might get the full amount and the other nothing.

    Secondly a full and final settlement could impact your credit. So you may not be able to get a new mortgage to 'have your partner taken off.'

    National debtline might be a place to start - and do everything with the loan company in writing. Don't reach agreements over the phone.

    Because it is secured on the property that OP wants to take 99% control of and OP's ex has no funds or inclination to pay off the loan ?
  • Surely, to secure a loan on a property, requires all owners of the property, to sign the loan agreement?

    Presumably they did at the time, before they separated.

    They may only get half from the equity, but they can still pursue you for the balance.

    They also know that most people will find a way to pay before their house is taken, as most "find" assets at the eleventh hour.

    Yes molerat your correct my ex has no intention of paying his secured loan knowing if i keep the house it will be paid from any equity As far as signing to secure the loan in his name only No i did not my ex defaulted on a bank loan with royal bank of Scotland They got a county court judgement against him and them applied to the court to attach the outstanding debt to the house and finaly if i cannot pay the secured loans i have no choice but to sell my house if they only get half of what is owed i will be able to pay the loan what is in joint names but i will not be obliged to pay the other
