Debt collection (marston)

Hi all

Im currently trying to dig myself out of one particular debt for £715 .

I emailed the company ( in a panic i must admit) and offered to pay £75 pw untill the debt is paid off.

However last week due to problems but have however paid £150 yesterday to make up for it.

Now they are threatening bailliff visits to seize goods.

i understand they have no right to enter as a dca, but i still do not want this as it is very embarrassing and will effect me as i am quite depressed as it is.

I would like to lower the rates i am paying per week as it is effecting my living standard and am struggling to pay bills.

is there any legal standing that i can lean on that says they ,ust accept my lower offer ?

    Hi,
    These companies are full of idle threats, assuming this matter has not been to court, they cant send bailiffs round, the matter would have to go to court first, this kind of action would be a very last resort.
    They are bullying you into paying more than you can afford.
    Simply write to marstons with an offer of payment you can afford, and just pay that, regardless of what they may say to you.
    You tell them what you can afford, not the other way round.

    is this council tax?
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    Marstons ARE bailiffs. They have no right to force entry and chanz may be correct to suspect that this is Council Tax under a Magistrates Court Liability Order.

    If this proves to be wrong, I'll delete the entire post!

    Council Tax Bailiffs have no right to force entry (unless they have previously achieved peaceable entry) but could in theory take goods (like a car) from outside your house. It's a case of not allowing them to harass you, parking the car somewhere else, and paying this as a priority over other debts.

    Have they already added their £75 and £235 charges?

    No, there is not. If there were, then of course very many more people would just offer to pay back far less than they agreed to, and no-one would ever be able to recover money that had been lent.
