Dispute with 1st Credit over everydayloans account

Hi all,

I had a loan with everydayloans that fell into arrears in 2009. A few months ago I started being hassled by 1st Credit.

I did a "prove it" and they sent some documents, however I think the address on them has been changed and they just don't quite look right even though they have my signature on. Also their sums don't add up for how much I actually owe.

The attached letter says "we await your comments".

Am I allowed to challenge the documents they have provided? I suspect they've gotten a move on due to this being statute barred in February...

    Ha, I could have fun with this one, start by asking them how there still in business after the old OFT severely rapped there knuckles a few years ago for "unfair debt collection practices", and half there clients ditched them overnight :D


    How much was the debt for ? is if its a large sum they may start legal proceedings if the SB date is getting close, I would stall them for a while by disputing anything and everything !!!!

  • It's £4000 so they might well try further proceedings. It's not a massive amount in the grand scheme of things but not insignificant either, I'd guess.

    Hmmm...so first comment should be to dispute the address and ask for a breakdown of costs? Sent by second class snail mail? :D

    There was a post on here not long ago from an ex DCA employee.
    Apparently debts that are nearing there SB date are considered "high priority" and are put to the top of the list for collection.

  • Well, update, just after Christmas I sent a letter with no address and signature on stating:

    "In your last letter, you stated that the attached documents have my "current address" on. Does this mean you have amended the documents? If so, I will require copies of the originals with no amendment.

    I would also appreciate a breakdown of how you have arrived at the figure you claim I owe. Many thanks!"

    Now, judging by their past response time (4 months after "prove it" letter) my next note could maybe be an SB one...

    Just an update - 1st Credit replied stating that the account is now Statue Barred and the file is closed.

    I cried with relief. It's been a bit of a fight.

    EDIT: Where are my manners?! Thank you to all who helped and supported :)
