Employment Termination

Hi All,

First time posting!

So I have quite a serious issue.

Today i have been terminated from my job, it was a part time position. No shift patterns ect, it was basically week by week thing. Get texted shifts on a monday for the week. I have been working there the last 2 years and it is paid on a hourly basis.

The last couple of years I have had a health issue where i have not been able to work when it plays up ect. I have had a maximum of 7 days off in the last 2 years where i was suppose to work. I have disclosed these issues to the managing director and he was absolutely understanding with it.

About 3 months ago a new manager started, she seemed to take a dislike to all the staff, and prior to my dismissal today 2 other staff member were terminated. One of them she bragged she just didn't like and the other she said was a lazy P****. No one wanted to complain about her to the managing director as she is his girlfriend :(

I always give adequate timing if i am really not well for them to find cover. And today i was suppose to work but due to my health and trip to the hospital i couldn't and received a text saying i will not receive anymore shifts and i have been terminated.

I am quiet upset because i have a mortgage and bills ect...

And basically i do not know what to do, as i will not get hired anywhere else with my health issues and time off ect.

I dont know if this is helpful but i did not have a contract or anything.

None of the above probable makes sense.

    Is it worth contacting the managing director and saying you appreciate x was probably upset but that you've been a good worker for x years and you would like the opportunity to continue? It might be worth a shot.
    Basically though you are from what you say on a 0 hour contract so they don't need to fire you but can just refuse to offer you work :(

    It is worth a try, but another staff member reported her for something before and it wasn't resolved or even acknowledge and they didn't receive a shift for two weeks :( not like i have shift loss to worry about now as iv lost the job completely. I will try and set up a meeting. Thank you xx

    Sorry to hear this. Do you have any form of legal cover (on your house insurance, perhaps)? As you have been there for over 2 years it may be worth making enquiries as to whether you have any rights given that they don't appear to have followed any proper procedures. However, if this was a 0 hours contract then it would be much harder.

    Did you actually reply to the text?

    If not, and you haven't told any of your colleagues, you could just ignore it and chase up future shifts?

    No I didn't reply to the text, as I was so angry and thought I was going to say something nasty. Which wouldn't have been wise. I have insurance for loss of job but it isn't nearly enough to cover the mortgage and bills. X

    Play on the weakness of them communicating with you via new fangled technology and the fact you didn't respond.

    Ring the MD asking why you haven't received any shifts for the upcoming weeks, pretend you never received such a message, then gauge his response.

    Chances are though if she is his girlfriend you're better off running for the hills as when that happens things rarely end well.

    The TBagpuss's question about insurance cover was about being able to get legal advice regarding your situation. This is often included as an add-on to household insurance and is normally provided as a telephone helpline service rather than a face-to-face meeting.

    First things to do are get a claim in for JSA and inform your mortgage provider.

    You say you'll never get another job because of your health issues but also say you've had no more than 7 days off in the past 2 years. That's actually a pretty good record.
    It looks as if you were on a zero hours contract but I don't know if that makes any difference as far as notice periods are concerned.

    I have been applying for jobs today so hopefully something comes out of it. Also popping down to the job centre tomorrow to see if I can be helped but I doubt it because they may just say 'claim on your insurance' which I guess is why it's there. Thank you everyone had some great advice!
