Tell your sister to appeal the warning on the grounds she was not informed that it was a disciplinary meeting, (an enquiry is not a disciplinary). She was not informed of her right to be represented (I'm assuming this). As she did not know it was a disciplinary she was not given the opportunity to review any and all evidence against her so the whole procedure would not be seen as legal. Tell her to do this immediately as most companies have a 5 day cut off for appeals. The appeal should be held with someone not involved with the original disciplinary hearing, this will probably mean someone from the company but external to the shop.
Why is she waiting for forms from USDAW she can join immediately online, see my previous post. If she cannot get representation from USDAW as it is something that was going on before she became a member then see if someone else in the company will represent her, or if you will be allowed to go in with her.
As a matter of interest how much was the overcharge and how did they know it was down to her? Unless it was an extraordinary amount then anyone with no grudge to bear would see it as a genuine mistake.
She filled in forms online but it said "thank you - we will send you out some forms....??? Unless she just filled in an enquiry form but I think she pressed the bit that said "join" because I was with her when she did it.
She apparently gave too much change and the till was about £40 out that day. Ok...if she made a mistake but disciplining in this way isn't going to help and it's the first time in 2 years of being there that she has done that.Praying at the church of MSE should be compulsory!

She only works until 12.30pm. They showed her some cctv footage but it didn't prove anything....you couldn't see how much money she was giving. I don't know whether they take readings from the till during the day....no idea. AFAIK the till was out.Praying at the church of MSE should be compulsory!

Firstly - Tills... does anyone else use the till either looged in or not during the day WITHOUT changing the float? Ie the tray with money should be used by only one member of staff. If anyone else has used it then I don't care WHAT CCTV says it's proven time and time again that people can sneak cash out infront of CCTV or worse when it's been out of sight to be cashed up...
You say she's been there for over a year? And this is the first time her till has been out? (not counting a couple of pennies - that's considered normal) Whilst £40 is a lot this should certainly not be a "last warning" offence with no previous warnings! Also as soon as a till is found to be THAT much out it should be locked and the till roll saved so the potential theft can be genuinely investigated. I'm not saying your sister stole anything! But that si how the company should treat it. At least until they can accertain if it was a keying in mistake or if the money has "walked off" (I would suspect into someone elses pocket...)
Tell her to ask for all the evidence they based this on, a copy of the CCTV footage, the till roll, the exact till count, who counted the float that evening, who else had access to it and who else logged into the till using that float.
