Hi, you all seem really good and helpful here so hopefully you can advice me on a scarey matter. My husband lost his pig farming business due to the usual rising costs and rather than go bankrupt we decided to pay off our £80,000 debts, so we sold our land and paid over half the debts and the remaining debts.
I contacted everyone and agreed monthly payments. All but one creditor agreed and they decided to go down the Marston Group way but we did come to an arrangement with them. After paying them for two years without missing any payments they agreed for us to pay the company we owed the money to which we did until one month the payment was returned to us.
We assumed we had completely paid the debt so increased payments to the other people we owed money to, but the company themselves had gone bankrupt.
We received a letter from the solicitor dealing with this asking for the money in full which was £1200, this we did not have, but I asked if we could pay £50 per month but never received a reply. Stupidly, I thought we would not hear again but we have had a letter pushed through our letterbox from Marston Group saying the debt is now £4299.38 and we must pay in full if not they will come and remove goods to that value.
I have written to them offering to pay £100 per month, paid the first installment. Sadly, they are not the friendliest of people to talk to and can be very intimidating. They are now saying they want the amount in full which we do not have.
Please, can they just do this. I would appreciate any help.

I can't help with this but (hope you don't mind) have broken down your post into paragraphs so it helps anyone who has good advice.

Marston's will be working as HCEO so I cant help with this but I know where you will get expert help head your thread Marston's HCEO this way it will attract the correct people to respond

As I said I cant help but it would be advisable to send Marston's a request for a breakdown of fees for both enforcement's of this debt If it was me i would send a subject access request also so I had all information relation to the debt enforcementI am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites

Hi Hallowitch - thankyou. The first we knew Marston had this back was the letter pushed through letterbox saying the debt was back in their hands and was now £4299.38 - I was at home when they came but no-one knocked on the door.
I contacted them as I thought it was a mistake and said we did not owe this amount. It was then they told us it was the company dealing with our creditors bankruptcy who had given it back to them.
I have written to them appealing about the charges but they will not budge and have also offered the monthlt payments.0
