Hi,
Hopefully somebody can help as I am unsure of what is law and what isn't with my former employer. I suffer from mental health issues (schizophrenia) and was sectioned (Early 2013) which is where the issues have come from (The company and people who work there are aware of my mental health issues, but not me suffering from schizophrenia)
I had previously worked with these people for 6 years at a different company that they sold and I got made redundant from. I thought that they were friends rather than employers so when they opened a new company I left my old job and went to work for them again, This info is just to give a little background.
I went to work for their new company and was working there for over a year when my medication stopped working and I got sectioned. Looking back the travelling time to and from work (5 hours per day) along with working long hours were a primary cause. Once I got out of the hospital I handed my sicknote in for 8 weeks but I was 'pestered' to get back to work as quickly as possible, which meant I went against my psychiatrist advice and went to my doctors to get a fit for work note, thus meaning my sick note could be ignored.
I had another relapse and my personal hygiene and pretty much mind went out of the window. I was only getting one hour sleep didn't wash didn't eat, didn't go anything bar go to work tbh. It came to a point where I couldn't physically get to work. I spoke to the MD at the company who I classed as a friend and was offered the chance to work from home on a piece rate contract (thus meaning my full time contract would be changed) This worked fine from May 2013-April 2014 until the work they allowed me to do 'dried up' and I went from £1100 per month to £400 per month if I was lucky. I had bills to pay and emailed them to say that it wasn't worth me doing it anymore and I want to leave with immediate effect.
Looking back, I feel I have been hard done to tbh, I have been loyal and it just doesn't seem right that they treated me like they did push me to get back to work, drop my piece rate work to such a low amount. I don't want revenge or anything but I am sure that I was entitled to Holiday pay which my boss says because my contract changed to piece rate I wasn't.
I worked from home when I changed to my piece rate contract, but still paid PAYE tax and NI through the company. I am curious if I was entitled to Holiday pay? If I am how can I go about getting this? I am struggling financially since the work has stopped and still on the road to getting my full health back, I could do without the stress of going through trying to get the money I may be entitled to but I really need it so it is a catch 22 really.
