Going to FOS. Any advice? I can't sleep at night.

I've got advice on here before about my mum using a Littlewoods account in my name fraudulently.
I reported to the police and have a CRN, but Littlewoods are saying they see no evidence of fraud, and therefore can't help.
They've written to me demanding £4000 or they will make me bankrupt.
They've also sent me a list of orders, delivered to three different addresses, totalling £5,700.
I've given Littlewoods 72 hours to reconsider, or I'll go to FOS. I need sleep...this is crippling me.
For the FOS, I've written out everything I know, including the Crime Reference Number, and I've got copies of my tenancy agreement and flights to and from the country I was in for the time period they are claiming. I was there for nearly two years.
Is there anything else I can include as evidence? I'm racking my brains but I haven't dealt with anything like this before.

Tell Littlewoods to suck a lemon. This is fraud and you have reported it as such. Would they pursue you for a lodger who had criminally used your account details and set up an account in your name? No! They wouldnt. If they were so stupid as to take you to court, you just sweetly produce the crime reference number and the details of your absence from the country and that will be that.Debt Free! Long road, but we did it

That is dangerously bad advice. The existence of a crime number is not proof of a crime being committed, it's just proof of a crime being alleged. It certainly is not proof that the OP is not liable, and it's perfectly possible that the court would not agree with the OPs version of events.0 -
As said above, a crime number only records that an allegation of crime has been reported, not that criminal activity has been confirmed.
You need to find out what action the police are taking, and if they are not proceeding , why not ?
You appear to have a simple case of theft/fraud where the suspect is known - it would be very strange for nothing further to happen.0 -
I have no contact with my mum. I haven't for years. She's mentally ill and refuses treatment, which means she is very violent and volatile.
The Police told me that they'd visited her, and spoken to her social worker. She is, I believe, currently bankrupt. They were going to send a special team to talk to her, because of her mental state, and decide whether to prosecute.
They took a witness statement from me and I signed something saying I'd testify against her if it went to court and I was required. They haven't given me any updates since.
I'm a bit lost as to what to do now. I can't afford to pay them - I would to keep them off my back if I could, but I just can't.0 -
Hi,
I remember your previous posts on this subject, to bring others up to speed, the OP`s mother has mental health issues, and ordered lots of catalogue goods in the OP`s name, the OP is now stuck with a 4 grand bill.
I'm sorry to hear this situation is still on-going.
Before you go to the FOS, have you had the final response from Littlewoods ? because if you haven't, then the FOS wont be able to become involved until Littlewoods have had a chance to deal with the matter first.
You have to follow a set complaints procedure, if you have had there final response, then you can fill in the complaint form on the FOS website, and start the ball rolling.
You must describe the events in as much detail as possible, and highlight how unfair you believe Littlewoods actions to be, post it all off to them, and they should be able to deal with the matter for you.
Please remember it can take a few months to investigate, especially if its a complex case, do remember to mention they have threatened you with Bankruptcy, (unlikely, but not nice).
Good luck with it.:)I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Thanks Sourcrates.
Yes, Littlewoods final say was a list of all the disputed transactions, and the statement that a fraud investigator had had a look and saw no evidence of fraud, so they would expect payment promptly.
They said if I had any further evidence I could send it on to them, or they'll consider the matter closed.
I can't see them changing their minds, so I'll start drafting out the long letter!0 -

Hi,
They wont be able to see any evidence of fraud from there end, as far as they are concerned, goods were ordered by you, and delivered to your address, they would not be aware it was your mother.
As I said before, the more detail the better, anything of a medical nature that can help you, Doctors letter, hospital notes etc, include copies of.
A complex case such as this may take time to sift though, so the sooner you get the ball rolling the better.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
