Revoking CCJ - Any hope...

In 2008 I owed Lloyds Bank approx £1000 debt on a credit card.
The debt went to a debt collecting agency.

Debt Collecting Agency have been in touch with me today to say I still owed £254.85 of this debt. I said I was shocked as thought it had all been paid but paid this amount immediately over the phone. They said they issued a CCJ on 1 May 2015 and sent it to my previous address, which I have been moved out from for over two years.

I had no idea of CCJ, else I would have paid it within month so as not to have it on my credit file. I now have a satisfied note on my credit file but of course CCJ will stay on file for 6 years.

Not sure whether to fight for a revoke of CCJ from what I have heard this is very rare.

  • Ok some good advice that I wanted to share that I have received from Debtline

    1. Should not have paid the amount straight away. Should have appealed to the court to set aside the CCJ on grounds that I did not live at that address, the length of time the debt has elapsed, potentially then I could have had a new CCJ and paid it within the month and not got it on my credit file. Now I have paid it there is nothing I can do.

    2. Now I have paid it there is nothing I can do apart from put a notice of correction on my credit file. At least this will mean that if anyone is doing a credit search it will need to be looked at manually.

    Can't believe by paying debt agency straight away has meant I have no hope in it being revoked. Also that a debt from 2008 could cause all this trouble and upset nearly 7 years later. I have no other debts sometimes life feels so unfair!

    You can still get it set aside if you have paid it, if anything it adds weight to your argument that you would have paid had you been aware of it.

    against you is the fact that you were in arrears but don't let that stop you trying
