Apprenticeship - pay rules

The current minimum wage rate for an apprentice is £2.68 per hour. This rate applies to apprentices aged 16 to 18 and those aged 19 or over who are in their first year.
Okay --
So if somebody does Level 2 at a college FT (semi-qualified status) and seeks to progress on to Level 3 (fully qualified status) as an apprentice then is this apprenticeship classed as being 'in their first year' or treated as year 2, thus usual MW of £6.50ish applicable.
This somebody being 28 years old at time apprenticeship starts.

It is the first year of the apprenticeship regardless of prior learning.
The first year (in this example) was not an apprenticeship and so the second year of learning will be their first year of an apprenticeship.
Therefore in your example, NMW for apprentices will apply £2.73 per hour.0
