Incapacity Benefit

I was working part time from 2004 (i did not earn enough to be paying tax )until the beginning of 2007 when i started working full time again and went sick on 15 th june due to mental health problems. Incapacity benefits say i am not entitled to any payment but they will pay my credits toward my pension etc. can anyone advise me what would be entitled to ? how many weeks do you have to pay contributions to be able to claim incapacity ? my husband works full time.

You have to have paid national insurance contributions over past 2 years.Did your employer not pay you statutory sick pay?0

I was not earning enough over the last two years to pay tax as i was only part time 10 hours per week. then i went ful time in January but it was too much for me ( I have had mental health problems and couldnt cope ) then i went sick in june after 25 weeks at full time - someone says if i had been working 26 weeks from january i would have been entitled ??? its only a small company and 2 weeks after i went sick the company closed down ????0

Unless you have worked continuously & paid national insurance contributions for 2 years before going sick then you have no entitlement to incapcity at all.
National insurance credits whilst sick do not contribute to any entitlement for incapacity benefit, they only help with your eventual pension entitlement.The bigger the bargain, the better I feel.

Move to Derry and contact your local SF office;)
They will sort you out fine, its not called DLA (Derry Living Allowance) for nothing:rolleyes:
On the serious side contact your local Citizens Advice Bureau for advice or go to one of your MLA's offices and ask advice, either should be able to put you straight.
