IVA notice of termination

Can anyone advise please. If you want to go bankrupt must you wait until you have letter from IVA company to say it's failed? I'm reading conflicting advice on Internet and I asked at my local court but they were vague and said I didn't need it in order to petition, but Im not sure that's right as they didn't seem that positive.

  • Check again with them and see what you get talking to a different person.

    Some courts want one and won't proceed with out where as others will be quite happy to proceed. It differs between courts.So there is no definitive answer.

  • If I don't need any document to say the IVA has failed at the court I go to, would I still have to wait until I have missed three payments or can I just go ahead and apply for bankruptcy?
