Holiday entitlement & Maternity leave

My wife has decided she isnt going to go back to work, i understand you still earn your holiday entitlement over the 26 weeks ordinary maternity leave, so my wife will have accured 10 days.
How does she get this entitlement if she dosent go back would it be paid ?

Thats correct you do and if the baby was due after 1st April 2007 then the OML is 39 weeks not 26.
It can either be tagged onto the end of the OML as paid hioliday or paid in a lump sum.

Baby was 27th January, she is not on unpaid leave at the moment.
Would it be best to ask it in her letter she is going to writ to hand in her notice.0 -
I am in a bit of a more complicated situation but same question. my materniy leave is only in its first week... so will not end until July 2008, or the paid bit will end april 08 which is still a different financial year, any holidays not taken are lost.
The company will not pay unearned holidays in advance, and I only had 4 days holiday earned and used these to supplement my wage when I dropped down from 4 to 3 days a week. (by taking long weekends for the last month)

Mrs D must inform her employers at least 4 weeks before she is due to return to work of her intentions

You are entitled to these holidays, they must either be paid to you or tagged onto your Mat Leave as paid leave. Speak to your HR department or failing that ACAS.
