The client hasn't offered me the contract yet but we have discussed it, as I believe they need it signed off by the board or something.
I guess I would never be paid the original rate unless I leave Hays without taking any holiday .
They are a shocking agency like all really...0 -
Take the holiday, the company can't refuse/stop you.
Hays will try and not pay you if you let them.
last resort is terminate the contract at end of holiday year if the company have not sorted out your contract.
They are going to have to let you take holidays once permanent so discuss how you get your holidays now and in the future and that hays will be trying not to pay you if this does not get sorted.
Another strategy is to increase your contracted hours but still work the same taking the extra as holiday to start using them up.
Much easier to be paid holiday on a rolling basis although this can cause problems if your contracts run on and you never really take time off.
(although technically rolled up not legal plenty of places including the NHS do it, as long as it is itemized on a pay slip there is no issue)0 -

If by "original rate" you mean the quoted hourly rate, you will never be paid it whether or not you take the holiday or leave Hays.
That is because the paid holiday is a legal entitlement which is not part of your worked hours and therefore the pay for it should not be included as part of your hourly pay for worked hours.
The NHS use "rolled up" pay only insofar as they pay holiday pay to their bank workers each payday but it is shown separately on the payslip.
Hays do not pay "rolled up" holiday pay: they just quote a figure for your hourly rate which includes an element for holiday pay and then they don't pay the quoted rate.0
