Council Tax Debt, Please Help..

Hello,
This is a query on behalf of a close family member and not me.

They have been having some trouble with debt, and been in touch with a crisis team and CAB. Personally I do not think they have been keeping up with minimal payments from credit cards etc, but still...


They have a degree of debt owing for council tax, and I do not know if they have paid the past few months. However, they got their wage slip today and the council have took two payments directly out of their wages. They have had no warning of this.

Are they able to do this? And is it likely this will be the case for the next few months until the debt is paid off?

    To inform the workplace, or to inform the individual? :)
  • Probably to inform the workplace. Some digging shows that they have to send a letter to the individual too.

    I only know this as a former colleague had this and the first he knew about it was from the employer as they were chasing debt from a former address (call it address 1) and he was in the middle of moving from address 2 to address 3 and was getting his mail sporadically, so not sure which address it went to.

    Does this mean we can appeal against it? As it leaves the individual quite short with around £700 a month...and their rent is £515...

    You can appeal to the council but they have the say on the issuing of the orders. They may withdraw one on the grounds of hardship/

    The council only have to post a copy to the last known address for it to be issued correctly.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    Your friend needs to have their whole debt situation looked at, including credit cards and other debts, not just these council tax arrears.
