Need advice urgently on a possible Statute Barred debt.

  • FOS (The Financial Ombudsman Service) have nothing to do with legal proceedings, they are just an independent adjudicator of complaints to do with Financial Services (Debt collecting being one).

    What happened was that Rockwell interpreted your last letter as a complaint, 'investigated' it (ho ho), and issued a final response - which they're required to do by the Financial Conduct Authority (search for 'DISP' rules if paint trying is getting too extreme for you).

    Going to FOS won't make any difference to the debt being statute barred, as you still won't have acknowledged it in writing or paid anything. If anything, they've shot themselves in the foot there, as FOS complaints take months to resolve (and cost the company about £550, regardless of whether it's upheld or not), by which time your debt will definitely be SB, payment or no payment.

    I would send a complaint to FOS (costs you nothing, win or lose), and inform Rockwell that you have done so - when you do, point out CONC 7.15.10 that Rizla King has highlighted, and sit back and wait for Dec 19th
  • I received a letter last week from Robinson Way, asking that I acknowledge that I am the person they are looking for. This was the first thing I have heard from this company.
    I received another letter on Monday asking that I pay an outstanding amount of £65 from a loan I had from Shopacheck.
    Now although I recognise this Company name I am pretty sure I havent had any dealings with them for either recovery or to make a payment for at least 8 years.
    My initial thoughts were to ignore the first letter, but I am now wondering wether or not I should ask for some kind of proof that I owe this amount and to double check dates. I dont want to open a can of worms but I have lived at my current address for 6 years as of Dec 14 and this is the first letter ive had at this address so I am sure its been that long at least!
