money refunded from CSA

On Friday the CSA contacted me asking for my bank details as I had over payed by £167.66. They explained that this went back to last June when I moved house and as I am stuck on CSA1 I had over payed due to my mortgage increase for the period from June to August.
I also asked them when my case would close as I was supposed to finish my payments last January but the CSA increased the age until 20, I do know that my son was due to start his degree this September , I did ask the CSA weather my case would close but the lady told me that it was not her department.. Does anyone know if the CSA sort over/under payments out just prior to closing a case.

    If your son is starting a degree course then Child Benefit should no longer be payable and rightly or wrongly this is what CSA use to decide if maintenance is payable. As a result CSA liability should have ended at the end of August ( see the link) , as it is counted as advanced education - https://www.gov.uk/child-benefit-16-19 Child benefit should be no longer being paid, so you could ring the CSA and let them know that you believe that CB is no longer being paid as your son is on a degree course and ask them to do a benefits check. If they check and find that CB is no longer being paid your liability will end. We did this recently when hubby's eldest had finished and apprenticeship and we believed CB was no longer being paid. It turned out that we were correct and we had overpaid and amazingly quickly for the CSA we got a revised schedule which included a refund of overpayments.
  • Thanks for your reply 13kent!!! the only paperwork that receive is a statement off the CSA every June/july showing my payments over the previous years.
    Does anyone know that if I enquire about the child benefit ending will my ex partner find out? As if she does she will make trouble for me and my family thanks
  • The CSA can check if CB is being paid as they have access to the interface.

    I think the CSA just check directly then I presume they inform both parents about any changes. We didn't get any fall out when they checked on our behalf, so I'm assuming the PWC thought it was just the CSA doing its own checks and knowing that she was continuing to claim when not entitled to do so as far as I know the PWC accepted the decision. (but I could be wrong of course!!)

  • as far as im aware you get over payments back, although iv read many posts from people who have had to fight for it, even though there entitled
