Yes I do say so because actually I'm right!
Very very few things in English law have to be in writing to be valid and a resignation is certainly not one of them. Obviously it is good practice and generally easier all round but that does not make it law.
Secondly "resignation" by absence is certainly valid. In any case it is a largely moot point as being absent without leave or explanation for a month would amount to gross misconduct for which the employee could be instantly dismissed!
There is a great deal more to all this than reading on page of a "government" website which, as has been explained, is nothing more than a layman's guide to good practice.0 -
So if an employee resigns but for whatever reason they refuse to put it in writing but you have independent witnesses that agree notice had been given verbally what do you do?If you say so. That will of course mean you are wrong but why let facts spoil your fun?
Force them to work because it's not in writing?Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked0
