Adecco - Holiday Hours Accrued

Hello everyone,

I have recently started working for Adecco (4 weeks ago) and there Annual leave procedure seems a little suspect to me. I have been told verbally and via email that I accrue holiday only for any 'full' week worked. This was described to me as working full time, Monday to Friday. The rate of holiday earned is .5 days per full week worked and she went out of her way to inform me that zero holiday would be accrued for any weeks that were not 'fully' worked.

I recently used a days holiday, for the bank holiday Monday just gone, to keep my weekly wage stable. The agency now say that I have earned no holiday for the week which included the bank holiday as it was not a 'full' week. However, around twenty minutes later, she told another employee she had earned a days holiday over that week because she did not use a holiday day on the bank holiday Monday even though she did not work it either.

It seems to me the agent is working under the assumption that holiday is not accrued on a pro rata basis and that those four days should not accrue 80% of a normal weeks holiday.

This seems even stranger when, with the agents approach, it would not be possible to take the statutory 28 days holiday on a schedule of one day per week until they run out. If an individual did attempt this it would only leave 24 weeks where it is possible to earn any holiday, moreover, if holiday is earned at .5 day per week the individual could only earn 12 days holiday anyway (assuming none of those weeks contained a bank holiday).

When we look at it from a less extreme scenario, by taking holiday in weekly chunks, there are only 48 weeks in the year which the Adecco agent believes holiday can be accrued. This means, instead of the statutory 28 days holiday, only 24 days can be accrued in the best possible scenario.

Now, if we factor in bank holidays and conservatively assume four of them occurred in the four weeks holiday taken, four still remain; bringing the total number of weeks which can accrue holiday to a grand total of 44. This brings the possible number of days holiday per year to 22.

I think it is safe to say the Adecco agent is incorrect in her statements, however, how do I push that point? I have brought this up once and she emailed to reiterate the 'company policy' which I outlined above.

I am well aware that Adecco's policy is nothing like this as i have a copy of the contract and have researched it on line. The sad thing is everyone at work believes Adecco are right in this assumption and are going along with it.

If anyone out there can confirm or dispel my suspicions please let me know. If I am wrong, I am wrong but I would like to know.

Lastly, I should say that Adecco have been an incredible agency to work for so far, if you excuse this matter. I really believe this is just one misguided individual rather than anything malicious.

    It's safe to say Adecco are in the wrong with their policy. They should crease your holiday pay pot by 12.07% of any hours you work.

    I have worked for many agencies and none have failed to adhere to the 12.07% rule.

    They are basically saying if you work part time you get no holidays.

    Clearly a breach of multiple pieces of legislation.

    To be fair, Adecco (though they did get me loads of work, and one of the clients offered me a job, so not too bad) have a disproprtionate amount of cretins on board....

    Whatever the one agent said about holiday accrual, you need to know how payroll work out accrual. I cannot believe that the person who is in a branch telling you the rubbish you have described is also the person who is calculating your PAYE and holiday accrual.
