ParkingEye POPLA appeal help please

I'm in need of help and advice please...I'm currently recovering from chemotherapy and a stemcell transplant and under normal circumstances would probably be able to handle this but I'm now getting a tad stressed and confused on what to do next.
I have received a PCN from Parking Eye for Morrisons Nantwich.
It was showing that my car had been parked for 2hrs 59mins when the limit is 1hr 30mins. I sumbitted and appeal to them using one of the templates from the Newbies sticky Thread (Thankyou!) as the registered keeper, which was unsuccessful, and have POPLA verification number but just wondering what I should say in my appeal to them.
I am a disabled Blue Badge Holder. I was travelling back home to Stafford from a break away in Chester and called into Morrisons Nantwich for some lunch and to do some grocery shopping ready for when I got home. I donot have any receipts as I paid cash for my goods and threw the receipts away. I have been unable to go back to the store and appeal to the manager as suggested on other threads due to the distance. I took my time with lunch and am not the best in walking hence the amount of time I was in the store.
Do I stand a chance in appealling or should I just pay the £80 (which I can't really afford) because the stress is something I really could so without at the moment.
The deadine for my appeal is Monday 1st Sept ....I havent been too good of late so I'm sorry for leaving it so late before asking for advice.
Thankyou in advance for any help you can give me!

just use one of the PE appeal examples linked in post #3 of the NEWBIES sticky thread, copy and paste into notepad and then adapt it to suit
bear in mind the BB isnt relevant on private land so wont be an appeal point (or they will ignore it)
they also wont allow any mitigation either
so stick to the usual popla appeal points, the legal challenges
and try using the RETURN or NEW LINE key to space things out better, like I did in this reply, your post is hard to read due to no new paragraphs
dont repeat that rookie mistake in your popla appeal
and complain to the Morrissons CEO and mention the BB and the EA 2010 too
if its all too much for you, pay parkingticketappeals.org £16 to do it for you0 -
Thanks for your reply Redx.....I'm new to all this as you can probably guess!
I've edited my original post so hope it reads better......0 -
It does ss - and I hope 'smiley' is becoming part of Life again for you.
Redx knows blue badgery inside out, from personal experience, so you can trust his advice absolutely.
I'm know more of the experts will be along to add their guidance, so don't fret any more just now.
Hopefully, we'll see your POPLA draft up here. As you've found, these scumpanies couodn't care less about mitigation, but the tried and tested mse POPLA pathway has a perfect succes rate. We'll help you get there.

If you get your PE-related POPLA appeal right (using the examples in post #3 of the NEWBIES sticky 'How to win at POPLA) then PE (on evidence from the past 4 months or so) just don't bother to respond, giving you a default win. Game over.
You're half way there having done your initial appeal and got your POPLA code. So start reading and developing your draft appeal for forum critique before submitting to POPLA.
Whilst any human being or organisation with even the most basic of understanding would recognise the difficulties you faced at the time and would withdraw the parking charge, you're not dealing with these types here.
Even POPLA will have no interest in your circumstances, so you mustn't rely on them to win this. You may want to allude to them in a very short opening paragraph of your appeal, but after that it's down to business, covering the standard appeal points:
1. No genuine pre-estimate of loss (GPEOL) - including the Beavis rebuttal (you'll see that included in the recent PE appeal examples when you read them).
2. Signage
3. No Contract with landowner to pursue charges in their own name at court
4. No proprietary interest in the land
5. Unlawful Penalty Charge
6. ANPR Accuracy
So please do your initial draft and let us see it. The one thing to keep at the front of your mind is that the POPLA deadline is absolute, miss it and there's no going back, and with PE this could lead to court papers being issued.
But to recap, get your forum 'signed off' appeal to POPLA on time and this will all be a thing of the past for you.
HTHPlease note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Thanks ampersand...always try to smile & look on the positive side of things & then ParkingEye happens!
I've taken the advice of RedX and have now asked parkingticketappeals.org.uk to appeal on my behalf.
Thank you both again for your help, really appreciated...!! :-)0 -
ss - please run and see what mse postie has sent to your pm box:-)

because this - 'have now asked parkingticketappeals.org.uk to appeal on my behalf.'
could well be unnecessary!
You could be well on the way to seeing this off, no payment, tonight.CAP[UK]for FREE EXPERT DEBT &BUDGET HELP:

as long as you win, consider a counter claim MCOL under the EA 2010 and "STICK IT UP EM" , typically worth £500 and it needs more protected people to actually issue an LBC and an MCOL when issues like this arise - ie:- fightback
basically, they hit you with a twig, hit em with a baseball bat (as well as the stiff complaint to dalton philips)0 -
ss- why not explain[as per pm exchange]and ask the appeal peeps[the business was started quite recently by posters on these Threads]to refund you.
I'm sure they wouldn't mind, in these circs.
The other way could/should bring quick closure.
Either way, I'm so glad you spoke with S. Now concentrate on bringing yourself back to Well Woman land.CAP[UK]for FREE EXPERT DEBT &BUDGET HELP:

Bonjour ss - hope things seem brighter this morning[determined rain here].
Just to reinforce yesterday's doings, look at this one, posted by Redx last week[he's also something of a BB specialist on these Forums]

I really would expect a previous stalwart of these Threads to reverse your CC payment given that you had cancellation offer help direct from Morrisons within 1 hour. i.e. Redx 7.47pm#2 >your good self 8.57 pm #6 > & 9.07pm #7.
Remember to go back to S. at work tmorrow.
I'm surprised Morrisons don't highlight this aspect of service in all of their PR/awareness/advertising. It's a Win/Win and would certainly make me think of them as a Golden Exception to the rule.CAP[UK]for FREE EXPERT DEBT &BUDGET HELP:
