I need help, he's refusing to pay for anything

    Thank you yes the 21,000 is registered in my interest and i am solely paying for the Mortgage out of my bank account. His recent behaviour is coming home late, laughing never having the children so I cant go anywhere. I feel truly stuck

    The court can order that he leaves the premises but this will only happen if you,via your lawyer,can demonstrate that the child is in immediate danger and/or is or is likely to suffer "significant harm".

    That seems unlikely in this case.

    The only other option then is to have the house sold,recoup your deposit, and move on.

    Fortunately, it's also accepted in law that a spouse should be be protected from abuse. It's very likely that this man can be kept out of the house.

    Another vote for your getting in touch with Womens Aid here - as well as very capable workers who will help you, IME they also have access to solicitors who specialise in this kinf of work and who are well used to dealing with people in difficult financial straits.

    When dealing with an abusive partner, they are amongst the best help you can get. :)

    Thank you everyone, Just an update my solicitor has advised a non Molestation order and Occupancy order. I have had to put a statement together from February when this all began, including police reports, My sons statement of his special needs and how this is affecting him. I also crashed my car on the way to the solicitors. I am still getting daily threats. The latest incident involved my sons grandmother having him..he was distraught without me. She ended up restraining him and called me to collect him screaming down the phone at me. I had another phone call the next day to say he wasn't welcome anymore and that if i died they would not care for him. Its been truly horrific... I will be representing myself in court, and have applied for counseling for my son as this is having a huge impact on him. Feel sick :(
  • I see you've been in touch with your own solicitor but have you had the same advice from Womens Aid?

    They said the same, that I would need a court order. Thanks for your reply, just feels nice to speak to someone as ive never been thru this before or even expected to
