mo and tesco now allied credit

hi everyone,i need some help,dont know how to settle this,i have a credit card debt with tesco,ive been paying 80.00 a month to triton,but last month i coudnt pay them so rang them and asked if i could pay half,theyh said no,and to send a soa in,i coudnt do this as i have had to finish work on health grounds and didnt kno how much i would be getting,anyway just had a call from a very agressive man from allied credit asking me to pay the full amount,i told him i couldnt and was willing to pay montly but he wouldnt listen and said i had to pay it in full,so i also told him i was claiming some charges back from tesco,and he acussed me of lying,said i coudnt as it was only for bank acounts,i know this is rubbish,so he now says i will have to go to court and pay all there court charges,help

  • Advise him you will contest this, continue to make the token payments - they amount you can afford. Inform him you will not be bullied. If they wish to go to court and I quote "case law states that where a defendent has been making payments, it is not common place to induce their owing further by awarding court costs against them". I would point out to him he's likely to get a lot less if it goes to court.
    Sometimes you just need to be mean back.

    i was making payments untill last month,i became unfit for work and was waiting for my incapacity claim to come through (took 4 weeks) then i was gonna ring them and ask for a reduced payment,so do you think i should write to tesco?i dont really want to ring allied,ive never been spoken too so agresivly before,very angy man (scared me really)

    Tesco's will tell you, that they can't help you, in effect they've probably sold the debt. I would contact Allied myself and speak to a manager. But if you don't feel strong enough then get someone who is, where you based - if close by i'll yell at em for ya!

    they havent sold the debt i asked the angry man from allied and e said they were collecting it for tesco
  • Oh then yes ring them, and argue that they're supposed to be a reputable company and why are they letting dispicable(did I spell that right) people treat their customers this way. Point out you may have defaulted on this particular card but there are plenty of years ahead where you custom could amount to thousands. It's all about the set up of the argument, knowing your bottom line etc. PM me if want to discuss more

    Firstly, do not worry about the debt. I know that is easy to say and very difficult to do but worrying about it will do nothing to help you manage/remove this debt. However, worrying about it can very easily make you anxious and or depressed and if you are already ill, that is the last thing you need.

    You said the ICB took four weeks, so are you now receiving it and if so can you post your SOA. You will find out how to complete your statement of affairs here.

    There are plenty of people here that can help you but we need to see your SOA before we can do anything.

    If you do not mind me asking, are you on your own and what type of accommodation do you have?

    hi,its very easy to say not to worry,ive been up all night worryhing,and when i slept i dreamt bout um,im not talking to allied anymore thats my first ting ive decided,the rest i have to think about,i thought of writing to tesco,anyone got a good letter?

    Nationaldebtline have a sample letter template here to cover for this eventuality.

    I suggest you complete it with your specific information and send to Allied recorded delivery.

    I also suggest you add the following paragraphs as complaint against this operatives behaviour (before the should our circumstances change para):

    I recently contacted you on (date) to offer a reduced payment while I was overcoming my recent issues, but this offer was refused. In addition, the operative wanted me to send an SOA, although I explained that I was unable to do so as my income was not clear at this time. The operative concerned accused me of lying and then said that I was required to pay the total amount owing immediately and threatened me with court action should I not be able to pay the full amount due. I believe a creditor is committing an offence if they falsely imply that non-payment of the debt will lead to criminal proceedings.

    In addition, the manner of your operative over the phone has been tantamount to harrassment. I believe these two factors result in your organisation breaching the Administration of Justice Act 1970, S40.

    I therefore request with immediate effect that you remove all phone numbers from your files and cease contacting me via the telephone, but in future use postal correspondence. Should I continue receiving calls, I will report your organisation to the Office of Fair Trading.

    I have continued to make payments and maintain communication during changes in my financial circumstances and will continue doing so as I have every intention of clearing this debt, but I feel the behaviour of your organisation is deplorable. I would appreciate a response as to whether you feel this behaviour is appropriate for your organisation?

    I suggest you copy Tesco and also send recorded.

    Are Triton your debt counsellors? I suggest you also send a copy to them too.

    hi,no triton were the people i was payhing 80.00 a month to,i have missed too payments,while trying to sort out my incapaity claim,then out of the blue i get allied yeserday.
