Fraudulent PDL's taken out by spouse

My husband took out numerous payday loans without my knowledge or consent. The first that i knew about what was going on was when i was called from work as bailiffs were at my house (changing the locks). My husband said it was a mistake but when i contacted the mortgage provider they said that the mortgage had not been paid for 13 months. I visited my bank the next day and there was a lot of payday loans going out of my bank. I had not seen any bank statements for quite along time (i had repeatedly reported this and they assured me that they were being posted. Although i still never received them). I also never received any correspondence from the mortgage provider, it turns out that my husband was intercepting the post. The loans were taken out via the internet using his ipad, email address and mobile phone number and my bank details (i never took my cards to work). When ever i went to the speed bank my card would be "eaten" by the machine and i would have to order a new card (8 times in 6 months) (why? because he was taking my card and changing the pin number so when i used it, it was retained). Unbelievable that your own husband can do this. I reported it all to the fraud police but have had no help what so ever! Am now paying £600 per month to an IVA and struggling. Surly there must be something that can be done, it is fraud and me and my children were made homeless because of his actions? Any advise would be appreciated. Thank you

    Hi,
    Sounds like an awful situation to be in. When you say the police were no help, why is this ?, what did they say to you ?.
    Fraud is fraud, what they should of done was give you a crime number to give to the creditors, you should not be repaying these loans if they were taken out fraudulently.
    Have you taken legal advice from anyone on this ? I certainly would if I was you.
    As regards the IVA, are these debts now included within that ?, if you are struggling contact your IP`s office and tell them so, get them to look again at your budget, they will have a certain amount of leeway to vary your payments, but if the figure you can actually afford, is significantly less than what you are paying, they will need to go back to your creditors for approval, but if your budget proves you need a reduction in payments, it should not be a problem.

    Thank you, i have a crime ref number, they said that my report would be sent to the MET police and that i may hear from them (fraud reporting line can not say if report will be followed up and it has now been 15 months). I gave the crime ref number to all the creditors but to no avail. I have been told that because i was married to him it is a civil matter! What ever that means. Oh and i meant to say that i am paying the mortgage and all the loans he took out through the IVA. He just walked away that day and i haven't seen him since.

    Before yo re-marry make sure you agree to separate finances and sole bank accounts.
