ex is going bankrupt, will I lose my home

Very briefly, 3 years ago we divorced and went our separate ways, we sold the marital home and divided the money accordingly. I have bought a new home but the mortgage still has the ex's name on it, when we divorced my solicitor drew up an agreement stating that he wasn't entitled to any equity as he had never paid into the new home. My ex has informed me he is either going bankrupt/IVA, will I be affected in ANY way. We have no other ties apart from his name on the mortgage, thanks in advance x

Why is his name on the mortgage if he has no interest in the property?
I guess ultimately it depends on what is logged with land registry.0 -
Did you have a court order?
When you split the money from the house, was the split an equal one, or unequal?
Is he a guarantor for your mortgage, or is the house in your joint names with a joint mortgage?
His creditors / trustee in bankruptcy can only claim his assets, not yours. They can only claim what he would be able to claim, so if your ex has no claim to your house, neither will his creditors.
You may be affected as you are linked to him financially as you are both on the same mortgage, which may affect you if you apply for credit, but that will already be true.All posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)0 -
I'm not sure what is on the land registry, how can I find out, the mortgage still has his name on it because on paperwork I couldn't afford it but I have managed fine for 3 years0

Get a copy of the title deed for £3 https://www.gov.uk/get-information-about-property-and-land/search-the-register
Then get onto a solicitor.0 -
When my brother lost his business, he also lost his home. He worked with a company called CompanyDebt.com to help orchestra payments, but there was something or the other where he did not sign something where his business would not be liable for his person. If you do find out who owns the land poppy, make sure that you let us know, after that further advice about your situation is possible.0
