House repossession cant cope

Hi, my first post and a desperate one, im 40 married with 3 children, we had a suspended possession order on our home beginning of the year, we recently missed a mortgage payment (no funds for said month) therefore solicitors have gone to courts for eviction... received notice for two weeks time. Filled out a request to suspend with the lovely CAB peoples help, and this shows an affordability of £20 left per month, therefore to avoid being "intentially" putting our home at risk, filled for suspension.
What I would like to know is how successful are these appeals, and with a £20 free per month, is it likely the court will allow us to keep our home ? I have no experience with this issue, and im too ashamed to tell our family's. I suffer from depression and have done for a while, this is really knocking the stuffing out of me. Cant eat.. sleep... crying all the while etc . The local council state we have to see what the decision is to see if they will help us as a homeless family without intention if that makes sense. Any help would be appreciated, even if your experience is not a successful one so I can at least prepare myself.

    Hello and welcome. I can hear from your post how stressed you are by this and am sorry you are in this situation. I am glad you are getting help from the CAB. I would also recommend the Samaritans as you sound like some help emotionally would be really useful. Their number is 08457 90 90 90 and they are completely confidential and non judgmental and can help you cope with this.

    You don't need to cope with this by yourself.

    There is no shame in getting into this situation it happens to many many people. I don't have any experience of these type of appeals but I guess it will depend on the judge looking at the situation and considering what might work best, whether your ability to pay will clear the arrears etc

    Please consider telling a family member or a friend as well. Don't let shame make you feel worse than you already do, you don't deserve to feel bad. Keep posting here - many people are much better experienced than me and will hopefully be able to provide you advice.

    So sorry to hear of your problems. We have been there and was a massive deal getting straight but we have paid off arrears now and touch wood on track. Depression and debt issues are closely related but you aren't alone. The Samaritans are great in terms of non-judgemental support - do call them.

    Do you have any equity in your property? If you do, selling the house yourself is likely to be a better option than being repossessed. I know it sounds desperate, especially as you have children, but better than being fleeced by mortgage company. Then you'd have a bit of capital to start again.

    Could you take in a lodger or two - their rent could help to pay your mortgage? My friend and her kids slept in one room, taking in 3 English language students for 6 weeks to make some much needed money.

  • Thank you for your replies, we have an eviction notice for two weeks time so cant sell the house before then, as we haven't got time, it would be a sensible thing to do if we don't loose the house. We have no spare rooms im afraid.
    I just want to know if anyone has been successful ? Thank you for Samaritans number if I can pluck up the courage to actually speak I will phone them, as at the moment I cant x

    Hi, I've read your post. I was in a similar position a few years ago. I had a repossession order put on my property. You mention that you are too ashamed to tell your family of this situation you are in, which I can absolutely empathise with... The reality hit me, when the repossession date came through the post... I also applied to have this suspended at a cost of £60 if I remember rightly, and this was accepted, however the arrears were so bad, I would have still struggled with this...It was then that I knew I had to swallow my pride and tell family members the situation I was in. A family member stepped in, advised me to contact the mortgage company directly, and ask the question "How much will it cost to make this situation go away?" (Maybe less than you think?) I was fortunate enough to be lent the money I needed by this family member at an amount I could afford, which I am still paying back (interest free!) I post this because I know how hard it is to approach family members or friends, however you may be surprised at how sympathetic they may be to your plight? Please do consider doing as I did. it's not easy.... however you shouldn't be alone in this. It's a huge weight to carry alone x

    Hello there,

    If you can show the court that you can pay the mortgage plus a little towards the arrears - and that the arrears will be cleared by the end of the mortgage term - you should be able to obtain another suspended possession order. Do take a copy of your financial statement along, and please do make the court aware of the Cheltenham & Gloucester v Norgan case.     David has the important point - if your offer to pay £20 towards the arrears clears them within the remaining term of the mortgage, then following the case of C&G v Norgan then the court should suspend the warrant on those terms.

    If the application fails and the eviction proceeds then my understanding is that the council has a duty to house while they investigate whether you qualify as homeless and in priority need. But that is housing law and not debt advice so I guess the guys on the housing board (or SHELTER) would know more.

    Hello and welcome to the forum Strawberryshortcake.

    While I have no experience with mortgages and possession orders etc I do understand how it feels to have your home taken from you. I have no better advice to give than what has already been given but I do wish you all the best and hope your situation is resolved or at least improves soon.

    Please do contact the Samaritans as they are a fantastic charity. You do not have t tell them anything you don't want to but I think you will find once you start talking then you will start to feel better only if it is slightly. I must also point out that the Samaritans are NOT judgemental in any way and anything you say to them stays with them. I hope you use that number soon.
