Notice Period

Hi I may soon give notice in and I checked my company handbook and it says notice period of 4 weeks plus 2 weeks for each year up to 12 weeks. So basically for the time I have been there it will make it 12 weeks this seems excessive for a technical role as I am not a manager or director. I maybe able to negotiate with my company and hope a new employer will not be put off. Is there any guidelines under "Notice of Termination of Employment to be in accordance with the Employment Rights Act 1996" I could not really make out any definite rules.

    I think I may have found it now - minimum of 1 week for every year worked but it can be more does not seem to have a maximum value.
  • You will need to negotiate with the employer, they would be entitled to hold you to this notice if required.

    I'm not saying you have thought about it but so you are aware if you decide to break the contract and only give say 4 weeks notice then you run the risk of being sued (realistically this risk is relatively small but can happen) and you also alienate your chances of getting a good reference (and bad references can be legal).
    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked

    This is the notice your employer has to give you btw, it can be less for an employee but it depends on teh contract and yours says as above.

    Statutory notice for an employee is 1week.

    Contract over rides if it expects more.

    Are you sure you have it right, more typical is one week per year with a min of 4 weeks/1 month.

    your terns would have you at 12 weeks after 4 years.

    Yes thats right after 4 years service the notice period would be 12 weeks! Bit excessive in my opinion.

    It may well be excessive, but you must have signed the contract when you started work to accept the terms and conditions of the contract.

    That is true but of course when starting a new job looking at the notice period is the least of my issues. I can ask to have it reduced but if not I hope my new employee will wait.
