Hi,

I have a MBNA credit card that has been passed on through a number of DCA's and is now with Shoosmiths LLP.


I was paying the previous DCA Wescot £36.50 a month off a £3500 debt but was stupidly late with a couple of cheques. However, I am on track again and am sending Shoosmiths £75 a month. 3 months later, they are still hassling me.

I don't have enough money to offer a F&F settlement but my circumstances have changed significantly in the last year and I am in the fortunate position where I could pay a few hundred a month and try and get rid of the debt as quickly as possible.

Does anyone have any experience of these guys?


Edited: - also to mention, I am asking them to prove their position as this debt has been passed through 3 or 4 different companies with very little communication to me. I would like to get it paid off though and am not looking to get out of paying it.

    When you say ask them to prove their position - have you sent them the prove it letter?

    When did your originally open the account? have you tried sending them a CCA request?

    If they couldn't supply a CCA then you would have a good chance of getting them to agreeing to a low full & final settlement offer. If they cannot supply the CCA you could of course not pay them at all, but then if they were able to produce it at a later date then they could then take action again.

    Hi Tixy,

    Yes, I have sent them a request for the original agreement. They have replied saying they are trying to access that information and have placed my account on hold until they receive the documents to forward on to me. I have paid them a total of £225 so far over 3 months and they are cashing my cheques so in effect, are accepting payment.

    For the moment I would not increase your payments. £75 per month clears this in 50 months which is not unreasonable anyway.

    But if you do have surplus money (say £300 is available) then I would put the £225 to one side and in maybe 8 months offer them £1800 in full & final settlement. And that's IF they find the original agreement. Probably half that if they can't.

    As long as your request was a formal s77-79 CCA request then any court action can be stayed until they comply.
