I'm near end flat buying process and thought my stamp duty would pay directly from bank to solicitor but solicitor tells me I would have to pay then once they get from bank they send me a cheque for stamp duty but only concern is not sufficient funds then to cover and having to use credit card to cover legal fee where they charge!

Hello
We've just bought a house with the same Halifax offer and Halifax paid the stamp duty and £150 direct to the solicitor who then deducted this from the total bill.
Maybe contact Halifax and double check that this happens everytime0 -
I believe it says in their terms (haven't double checked the current offer, but it was like this in previous offers) that they will TRY to pay the stamp duty to the solicitors before completion, but do not guarantee it and you should have the funds available to pay it yourself.0

Hi,
We completed on the 8th August and had the same offer through Halifax. In our case Halifax paid both of these direct to our solicitor and we didn't have to do anything about it, and our solicitor never mentioned that we would have to pay and be then be refunded.
I don't know if this works differently for each solicitor though but this is what happened for us.0 -
The funds are supposed to hit solicitor account on completion day.
However, when the scheme first started, a number of borrowers didn't get their money on completion day and it had to be done by cheque.
Since then, Halifax has advised borrowers to have the money to cover the SDLT on completion, just in case the same thing happens again.I am a mortgage broker. Hi
I also applied (July 2013) in branch for Halifax mortgage with Stamp duty & £150 cashback (have account with them). It was a long process. Was waiting 6 weeks for valuation and another 2 weeks for mortgage offer. But after valuation took place the adviser called me to the branch again and said they have new deals. I had to pay SDLT, but no product/legal fees and get slightly lower rate. Also they promised to give me £150 cashback and £500 Prepaid Mastercard. They also said I'll get discount on conveyancing ( used their solicitor).
When my mortgage started (November), I got my Prepaid card 80 days later, but no £150.
In April this year I saw £2400 (which equals to Stamp duty I paid) deducted from my mortgage balance. Next week I got a letter by post stating: "Thank you for you recent Capital Repayment towards your mortgage. Please see your new monthly payment (£10 less a month). You don't need to do anything." etc.
I didn't have this mentioned in my mortgage offer. It doesn't show were money come from (only shows as Capital Repayment online) That was a nice surprise. Is it their mistake? Will they ask for money to be repaid back to them?
Did this happen to anyone?
Thanks.0
