Redundancy Pay

Hi,

Does anyone know if there is a legal requirement of redundancy pay ?

I have worked for the family business since 2001, leaving at end of July. Boss (Dad) wants to give me his old Citroen Berlingo van (swap with my new one), which I can use to part X with a new car. The van is really old, its always conking out, the rear view mirror has fell off, the sun visors have broken off, the van back doors doesnt lock and it always conks out.

I said 'oh is this part of my redundancy package' he just laughed and said a swear word :mad:

On another note my Mum is paying off my bank loan from a house sale, she inherited the house , not Dad. Dad will say oh well thats your redundancy pay but that should be seperate shouldnt it ???:confused::confused:

Can anyone help ? pls

    If you are employed then yes there are legal requirements for redundancy. The capped limit is £310 per week for each week worked but is based on your average weekly earnings.
    Your age is also a factor - your best bet would be ACAS.

    On Acas website Ive worked it out to be £1314. He reckons I should get 1k in part x for the van (the personalised number plate is worth £400-£500)

    Ive clicked on both links and I cant find anywhere if the weeks pay is before of after tax, Ive calculated it to be after tax :confused:

    You would be entitled to however weeks gross pay. Statutory redundancy pay is paid free of tax (although you have to be careful if there are elements such as accrued holiday pay as these may well be taxable.)

    So it works out at £1615, that sounds better !

    Ive spoken to Mum and Dad doesnt agree that he is making me redundant. I hope this doesnt cause a family argument :eek:

    Either you are:

    1. Leaving of your own accord and get nowt

    2. You are redundant, in which case you are entitled to have the statutory procedures followed and redundancy pay

    3. You are being dismissed. Again statutory procedures apply.

    Failure to comply with the procedures would give you an excellent case at a tribunal, although I guess you don't want to do that in a family company.

    No i wont want to go down that route. It basically started by me choosing to go part time to help it out with the cost of the wages. Then we had a rent review and I said shall I look for something full time and he yes.

    Then when I was filling out app forms I asked him if I should put redundancy down as the reason for leaving my present job and he said yes. So I take that as i'm being made redundant. I would never make me redundant, he would of waited for me to go on my own accord, I was getting hints all the time that they couldnt afford to take a wage for themselves cos of paying me.

    I'll hopefully find the right time to say lets see what the van sells for and give me a cheque to make it up to the £1600. ;)
