What are my options here? Have I no option but to pay up? I am hoping to get a mortgage next year and worry that my now relatively-clean credit record will be ruined by this. If I start to pay them by instalments, will this show up on a credit search?

    Thanks for your help!

The ccj fell off your record in 2007. It's not going back there.

This is just a debt now, and arguably not a priority one. Your options are to

    1. ignore
    2. pay in full
    3. pay by instalments
    4. be cheeky and offer a sum in full & final settlement

I think I'd try 4 (reminding them of their questionable powers of enforcement) and then go to 3 if I really couldn't get anywhere.

There are a few of these cases around so it may be worth doing a search on here, and consumeractiongroup and legalbeagles to see how others are doing.
  • Hi all,

I've found myself in an almost identical situation to Beverley 1976 and am wondering if anyone knows if I can intervene with the new creditor's attempt/request to the court for permission to enforce a CCJ over 6 years old?

I believe that the original creditor (the Student Loan Company) did not take reasonable action in enforcing the CCJ in the period since it was granted (in 2002) since the creditor has always had on its’ records my familial address yet never made attempt to contact me there, and I would like to make this point clear to a court.
Is it even possible that I can be involved in the process when the creditor applies for enforcement permission from a court?

    Many thanks.

Beverly1976 got a threatening letter from Erudio. Is that what you've got?

    Or has this gone further?

National Debtline are pretty good on this, if you want to chat it through with someone.

Yes would be nice to know what actually happened in the end.
