Should I also report them to the financial ombudsman? I would assume this is bad practice from link financial?
You don't have any real cause to complain to the FOS.
A bank or financial institution is only required to keep paperwork for 6 years, can you imagine how much paperwork they must have to trawl through to find your one single agreement ?.
This could actually be good news for you, if they cannot find the agreement, they cannot obtain a judgement against you. bad news for you it would be an electronic signature, also after 2007 they can reconstructDon't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.0

Account was opened in 2002 though, so even if taken out online, it was practice at that time to also obtain a paper copy, which would require a signature.
Also it was a tick box,(dependant on company) not electronic signature then as well.
This is why catalogue companies have fallen fowl because they sent out agreements, even with online accounts, and people did not sign or return them, hence a few years down the line, a DCA has picked up the debt, they do not know how or when an account was opened without referral to the OC, if the OC has not kept records, no one knows if it was an online account or not.

With regards to this question, its been over 30 days and no reply from Link. Also I got the dates mixed up, I've had the original account with MBNA since 2011. I was thinking of my mint account when I said 2002 (which I payed in full some years ago) !! Sorry..
Is there a prescribed time for Link to get back to me? I'm still paying them the agreed amount of course.

So I got my agreement finally. Its in very small print, quite hard to read. It had a page at the end from link telling me the contract is now cancelled and i must pay the balance owed immediately. It also said the balance to pay may increase with interest claimed under s69 county courts act 1984 as well as legal costs.
I assume I just write to them explaining I can't pay in full and set up a standing order again? Or am I likely to get taken to court?
