Gas and electricity arrears

I was not in arrears to my landlord, and when I asked the OR she confirmed (twice!) that she would NOT be contacting him.
I have to say I think it is your right to have a pre-payment meter fitted (and in the first instance we had one, we had no choice!) We owed £350 and couldn't pay so they fitted one in order for us to receive electricity!!!! The landlord had no say in that case. But they have no real reason to complain.

BTW it is also fine to include things after BR. Anything that you remember/find after you OR interview, is still included and can be forwarded on for the OR to deal with. (We found an extra £3500 that we owed, that we omitted from our original declaration of bankruptcy!!)

Details of how the OR and HMRC should deal with Tax Credit overpayments in bankruptcy is here:

    http://www.insolvency.gov.uk/freedomofinformation/technical/techmanvol1/Ch73-84/Chapter77/part7/Part7.htm

But as always with these documents, it is far from an easy read. I don't really know the TC system anyway (especially regarding collection of overpayments), so I'll not presume to try and interpret it.

Has anyone any advice i am in debit with both my gas and electricity i am paying both off one by direct debit to cover what i am using plus the arrears and the other on a gas card, national debtline tell me that i need to include them in my bancruptcy is that right,if i do what happens to my supply.
    thanks

Yes - include them in your debts, the worst that can happen is that the supplier will insist on fitting a pre-pay meter, but if the arrears are included in your bankruptcy, the supplier will NOT be able to 'adjust' your tarif to recoup these.

  • Hi,

I included gas, electric and council tax debts on my BR and had no problems at all. I am with EDF and they did not even contact me just set up new accounts exactly the same as before but with a zero balance and starting the day of my BR. Council tax wrote off about £350 no problem.

If you want to get help to pay of utility debts EDF have a charitable grant fund which you can apply for. In fact it is the only place you can go to to ask for money to pay for your BR. It takes about 3 months to process but they will give you a cheque to take to the Court to pay all your fees. Ask CAB for details.
  • Hello,

I have been told to put everything including gas electric and water rates down on my form if I owe these companys any money, and it will be included in your BR.

As to the prepayment meters you can get them for gas and for electric they are just like a pay as you go phone!! it has nothing to do with your landlord, it would be a polite to let your landlord know what you would like to do, but, and I was told this not long ago by a helpful chap at EDf when I had trouble paying a large winter bill, that the meter belongs to them and not to the landlord and if they or yourself want to put a prepayment meter in its up to you as the consumer or them as the supplier, your landlord may own the house but the meter is theirs.
If you get too far behind on your bills or any payment arrangement with them, they insist that a prepayment meter be installed anyway, regardless of what the property owner thinks or wants.

    hope this helps.

  • Sorry just thought, also now you can request that a water meter be installed too, that way you only pay for what you use, this may not serve well for a large household, but like me where there is just myself and my son, why should I pay as much as the house next door which has 6 people living in it, they obviously use more than we do, its all worth thinking about to cut you cost of living.
