Endowment Misselling Claim against English Solicitor - any successes?

Anyone out there been successful in claiming for missold endowment by an English solicitor? I'm at the stage (3 years after initially contacting Standard Life) of an investigation by the Law Society. However, I know that the Solicitor concerned has moved on and the successor firm are claiming that all my files have been destroyed (legally they can do this after a certain time period). The Law Society are saying that because of this, any claim looks unlikely to succeed due to lack of information. I thought that the burden of proof was on the solicitor to prove they carried out a proper risk assessment etc rather than for me to prove that they did not? Looks to me like the Law Society are protecting their own!!!:mad:

The Law Society work differently to the FSA. The FSA require the advising firm to show it was best advice. The Law Society need you to prove it wasnt best advice.
Its not the end of the world though as Standard Life have been coming round nicely and many are getting back on track again (once terminal bonus and mortgage promise value are added to projections).
