porting my mortgage problems

i am going through the process of applying to port my existing mortgage. on the day i was intending to send the forms and fees i was informed that i had been gazumped. i telephoned and explained the situation to the mortgage company (oakwood homeloans limited). i explained that i needed to know what would happen with my fees if after sending the forms but before they've processed my application, i decide to pull out. they told me the funds are non refundable. i asked how they could keep £290 for a valuation fee if no valuation needs to be carried out and how £395 could be charged to port a mortgage that does not exist. the reply was all fees are non refundable. is this right? if i inform them that i don't want to proceed because i have been outbid can they keep my money for work they haven't done?

If their fees are non refundable and that was made clear in the paperwork, then they are in the driving seat.
