My way of thinking is as I did not get the service I won't pay. I know it seems not fair for many people but to me these companies make huges profits, fair enough as long as they give you something for your money.
They were giving you something for your money - they gave you access to the gym facilities. That you chose not to use them is no fault of theirs so why, in your view, should they lose out on the amount you contractually agreed to pay?
Put it this way - if you bought a season ticket for your local football club but couldn't go to a few matches, would you ask the club for a refund? No plans on moving in the near future, buying a new car / bike or decorating the flat? No plans on changing your utility supplier or insurer to a cheaper one in the near future? they finally recognize they made an error a few days before sending this to a debt agency... no way to stop the process.
I don't understand why you want to protect their business model which is overcharging people. They hope that many people won't attend. Law should be here to protect us, and prevent them for making it difficult to unsubscribe. I paid almost £ 3000 over three years to end up with a crashed credit record... bravo;

To those stating "why didn't he send a letter?" as email can get missed,deleted accidentally; I don't see any logic in this.
I can make the same point and say that letter can go unread or missed in the post and in order to prevent this to some extent, you have to pay extra for(send the letter as signed).
On the other hand, you send an email,it goes through faster and you have a digital proof that your email has gone through; an email won't go MISS on the internet and if they delete it accidentally then that's their problem, not the sender's.0 -
What does your contract say regarding cancellation? If you were eligible to cancel, and followed the cancellation procedure, then you are in a position to dispute the charges. If however you were tied-in your case is weaker.
Arguably you should have followed this up sooner, but that doesn't necessarily mean you must have. If you followed the correct process (and have evidence of this), and didn't use the facilities, you have a good defence should they try and take you to court.
