Anoher Ex who can't pay the mortgage...

I've been dipping in an out of here for a while and have picked up some valuable tips/knowledge. Broadly speaking, my problem has been covered several time before, however my situation is slightly different to the others I've read; I'm hoping that someone here can shed some light...

Essentially this is the age old problem of an ex not paying the mortgage. We bought the property together, in about 2003 and split up in 2009. She moved out and I continued to live there until such time as some renovation work was complete (I was doing it). It was then put on the market, I moved out shortly after and shortly after that, tenants moved in.

The rent covers the monthly mortgage payment, with a little extra. On a number of occasions since, it has come to my attention that mortgage payments are being missed and/or the arrears payments, scheduled as a result of her non-payment, are not being made.

Recently this has cropped up again. She is currently on holiday in France, so I'm having difficulty in contacting her to get to the bottom of the current issue.

Each time this has cropped up, I have spoken with the mortgage provider; they've been pretty understanding, but haven't been able to do any more than be generous in the time they allow before escalating things toward foreclosure.

So, where do I stand? What options might I have?

In an ideal world, I would like to take possession of the property, though the likelihood of this seems small (although I pumped a great deal of money, time and effort into renovating it and so raising equity in the property, I would have a very hard job to prove it, water having passed under the bridge etc).

Any thoughts, advice etc very gratefully received!

    Sell the property and cut your ties.

    Is the rental income being declared to the HMRC?

    The erratic payment history will be a negative on your file.
