Capquest want £250 with no CCA from 2007 Vodaphone contract

Hey guys, I have received a letter stating I owe £250 to Capquest. I called them up enquiring what debt this was against and apparently I owed this to vodaphone back in 2007 and the account was defaulted in 2009. I don't recall owing the money's the vodaphone however I asked for a settle fee.


They said how much can I pay so I asked them for at least 50% and they gave me a chance to pay £122 on this Friday.




Do I pay this to get it off my back even though I don't agree with me owing the money or do I appeal against it? I simply cannot remember owing money to vodaphone from 2007.


I asked for a CCA they said they do not have one as it was done online and it is a service only contract?


any information would be appreciated for my request .. thankyou in advanced.

  • They are right that the Consumer Credit Act does not apply to mobile phone service contracts.

    Would I pay something I didn't think I owed? No.

    I'd send a prove-it

    If it turned out to be valid and it was within six years (5 in Scolland) since I last acknowledged the debt by payment or in writing and I wanted to pay it...

    ...then I might consider a full & final settlement deal but would want this confirmed in writing before parting with cash.

    Capquest are useless. Even after you have settled the debt make sure you get it in writing as we had a similar situation, 6 months after paying in full they started chasing it again and added more fees onto it. They then sold the debt onto other companies who also chased us for money.

    CapQuest were calling me a few months ago asking for me to call them.

    I kept missing them for about a week as they kept ringing while I was at work. Eventually I got sick of the voicemails, so I rang up, they asked if I was Mr. X (can't remember the name), I said no, and they haven't called me since.

    I think they just fish a lot of the time.

    Also had the same recently from Frederickson.

    They all try it on.

    Why would you ask for a settlement fee on a debt you don't even think is yours ?
    Have you ever had a mobile contract with vodaphone ?
    Send provit letter first, see what they come back with.
