County Court Judgements on Equifax without Date Satisfied

Hello

Sorry I think I could find this somewhere on the Board but haven't been able to yet...

I am in the process of cleaning up my credit report and getting things marked satisfied. This is straightforward with my credit agreements, but under 'court information' I have 2 CCJs. One is marked satisfied, and the other does not have a 'satisfied' date. However, it also doesn't outline the creditor, only the court info.

How do I go about getting this settled/satisfied?

Here is the only info that appears:

Name: xxxxx Date of Birth:
Court Details: NORTHAMPTON CCBC / xxxxxxxx [there is a 8 character reference here but I'm not sure if it's linked to me or just a generic one, so I removed]
Type: County Court Judgment (England, Wales and Northern Ireland)
Court Date: xx/xx/xxxx Amount: £ xxxxx
Date Satisfied:

(so, no Date Satified listed, just blank, and no details of creditor - & I'm actually not sure who this creditor was)

Thank you for any help!

  • CCJs are usually left without a satisfied date post discharge. So far as I know there is no way to make the court change this.

It doesn't matter anyway as the CCJ should fall off your file before the Bankruptcy marker does, and you BR marker trumps CCJs anyway so won't make much difference in the end.

Thank you! That makes sense, I can leave it then. I'm getting the credit cleanup bug and was trying to tidy everything! :)

Did the date of the CCJ pre-date your BR petition?

    Or, did it occur afterwards?

Northampton County Court is the Court nominated for online claims.

For others reading this.....if one is Undischarged, or Discharged BAnkrupt, then one should respond to any paperwork from the Court that appears on one's doormat.

One has the ultimate Defence to get the claim set aside.

Respond to the Court...[rather than the claimant]...citing one's BR date, and reference.

This, too, can be done online. [One has to register as a Gateway user..username & password]......the Court then informs the Claimant they are pee-ing into the wind, and the Claim is removed.

This little bit of inconvenience saves a load of hassle, if the Court grants the Claim [which is unenforceable anyway], ignorant of the Bankruptcy Petition.

The Claim will be set aside, once the Court is made aware of the BR Petition...but it is still likely to appear on the credit references.

If the CCJ is already on the credit file as per what the OP written, then the judgement has already been passed. As I understand you have to pay to apply to a court to have a judgement set aside and if the CCJ pre-dates the BR then this is a complete waste of money as it makes no difference as the CCJ will drop off the file before the BR.

I agree....however, a pre-BR CCJ is simply unenforceable, but the Order still stands...post BR, the Court was unaware of the BR....and there is the option to seek a set-aside.

However, the major point I wanted to get across focussed on what should be done, if a BR receives Court paperwork....how to respond, and the reasons why.

Post-BR, the above avoids any issues of record.
