Assuming that the car park is owned by the council? Then yes, it's legal The offence is littering and councils can issue a penalty notice. I'm not sure that many enforce it that strictly though. Sounds like your friend got unlucky and there was a jobsworth on duty.
They can take you to court for not paying the penalty, again I suppose it varies between individual councils how like they are to do this.
