Catching up on my PCN

Apologies to all the regular helpers but I've no idea how to locate the parking issue that I raised; it's not easy (for me anyway) to navigate this site. I've trawled through the pages in May when I last posted and drawn a blank.
My position in May was that Smart Parking sent an NTK and I despatched the obligatory letter of appeal on 12 May. I have the Post Office receipt. Eleven weeks have now passed and to date, I've heard nothing; although I've looked through all the NEWBIE advice, I can't find anything that indicates how long the wait's likely to be.
Should I sit tight, or chase them?

I would email Dmart and tell them that since the 35 days are up to consider the appeal, you assume that the PCN has been cancelled since you have not heard from the, if not they must issue a POPLA code immediately.
Also complain to Steve Clark of BPA (email address in post 6 of Newbie thread) that you have not heard from Smart within the required time frame.Newbie thread: go to the top of this page and find these words: Main site > MoneySavingExpert.com Forums > Household & Travel > Motoring > Parking Tickets, Fines & Parking. Victory!!! :T At last, Smart Parking has cancelled the PCN for my two minute stay in a disabled bay during a horrendous storm at Coventry’s Asda. And it’s all thanks to this splendid Forum’s commendable advice from the stalwart regular contributors.
When I queried SP’s failure to respond to my appeal, I took the advice of Dee140157 and Emailed a copy of my complaint to BPA’s Steve Clark. He said he’d investigate and asked me to forward a copy of my original appeal letter. Before I could do this, Smart Parking Emailed me, no doubt because I let them know I’d raised the issue with BPA.
They claimed I’d been notified about the cancellation and forwarded copy from their log showing a letter despatched to me. Interestingly, the log also claimed an earlier letter of acknowledgement had been sent; I received neither!!! As there’s never been a problem with missing mail at my address, I responded by saying it was stretching credibility too far to claim there’d been two letters from the same organisation, despatched weeks apart, but to the same address and yet both had gone missing.
Smart Parking’s verbatim response was “I am sorry that you do not accept the fact the PCN was cancelled within the time period allowed by BPA, all of our letters as dispatched on the date shown on the correspondence log, if you are not receiving them Smart Parking cannot be held responsible, we respond to all appeals received and do not attempt to cut costs by not sending letters.”
SP copied this to Steve Clark at BPA. His verbatim response to me was “... I am pleased that Smart have cancelled your charge. As the PCN has been cancelled, our involvement in this matter comes to an end and I have closed the case accordingly”.
When I refuted SP’s claim that correspondence had been sent to me, I’d also asked if Asda got a rake off from the profits, which I understand happens in some cases, ie, unbelievably NHS hospitals! Both SP and BPA ignored this. Neither does it seem that BPA is concerned about repeated failure of mail reaching its target, nor the worry this causes stressed-out motorists. Seems we're just small fry and presumably, SP will conclude that it’s clear to continue with its money-saving administrative malfunction!
I haven’t bothered to respond to BPA or SP; I’m in too much pain. If I'd been able to find the energy however, before putting this lot to bed I would've been happy to chase Asda for lying about car park ownership; this was ignored in my letter of complaint to the CEO. The public ought to know that customer’s letters addressed to ASDA’s CEO, no matter how egregious the complaint, don’t reach his desk; they go no further than the admin pool. Some customer service!
Sadly, the knowledge of the admin pool, charged with responding on the CEO’s behalf, is pitiful. He should take note of their ignorance, although one wonders if he cares. In response to my complaint, I was told “…. It is a legal requirement to display a blue badge whilst parking in these spaces. …”. We all know, that’s bull poo, as I discovered from this Forum!!!
Anyway, got that off my chest, so all that remains is for me to say a final thank you to everyone who makes this Forum work and wish all other wracked off motorists the best of luck. Just follow the forum advice and you’ll all be laughing. :rotfl::rotfl::rotfl: Sincerely, Truly Wracked Off.
