Hi my partner has just gone through a divorce and when her son reaches 18 in November the ex husband will be taking his name off the mortgage and this will mean her losing the house as she is on benefits (due to accident at work) even though the ex husband hasnt paid the mortgage for last 8 years. She is with alliance and leicester/ santander and wont allow her to keep the mortgage by herself even though in credit and never defaulted. I have just divorced and my name is on the mortgage of my old house as my ex wife cannot afford to take my name off until my youngest is 18 and she is currently 11.
My partners mortgage is only 34k and the one my name is on is 105k even though do not pay towards as just name only. I earn about 40k a year is there anywhere we could re mortgage in both our names for about 30k as she has some savings? We were on the phone for about an hour with her current mortgage lender about putting my name on it and they said that the calculator said no.
Can anyone point me in the right direction to try sort this out as we dont have much more time and do not want her to lose her house.
Thanks Darren

The fact that you don't currently contribute to your existing mortgage . Doesn't absolve you for being liable for the mortgage payments.
With regards to your new partner. Has the ex any entitlement to any of the equity in the property.0 -
No he hasnt any entitlement to any equity.
In my consent order it states she must pay the mortgage every month and indemnifies me in full against all liabilities arising from any default made by her. Would this not make a difference?0 -
Speak to a broker, with the right lender/broker this should be achievable
It will be away from current lender though..
All the bestI am a Mortgage Broker

She will NOT lose the house if she keeps paying the mortgage and the EX cannot just take his name off the mortgage even when his SON is 18.
Is he still in full time education? or working ?0 -
Anyone recommend a good broker we can speak to as need to sort asap? Thanks0
