Hi guys and gals wondering if you can help me.

roughly 2010-2011 I had a contract phone that went sour beig young and naive I didn't pay the debt but heard nothing from them until around 2013 when lowell contacted me via letter saying I owed £500 or so . I replied and payed £5 a week for two months then all of a sudden I couldn't pay because of working only 6 hours a week I informed them that it was getting me down and depressed they agreed to freeze the account for 30 days so I could gain JSA pr new employment. after 30 days I hadn't gotten a new job and found out I'm not eligible for JSA (live with gf / gf's mother ((homeowner) but they wanted they money I couldn't pay so they sent 2-3 more letters before I asked my parent to help and they phoned the company up explained the situation saying I was penniless and depressed and so they said they knew they wouldn't get any more money of me and my parent offered to pay £5 a week as they aren't earning alot either and that was that or so I thought today after havibg an interview for the first time in months and looking quite hopeful I return to find a letter from RED DCA saying I need to pay the outstanding amount and that " we will obtain a copy of your credit file blah blah blah decide what course of action, apply for CCJ and I must pay or they will apply for my bankruptcy" I haven't talked to them yet but need help ASAP please

    It is best to start your own thread, however

    If the debt is not being paid, or is being paid off slowly then it is quite usual for it to be sold on to a new debt collector, or for one to appoint another to collect the debt.

    How much does the letter say is owed now?
    Are your parents still paying towards the debt each month?
    Are you in a position to start paying anything yourself? presumably you are receiving JSA now (if you are not working yet).

    Just spoke to my parent and they have said they have made an agreement 2 weeks ago that she will pay £5 a month but was unsure when she would pay as she changed jobs recently and told them to freeze the account and she'll phone them back when she can (this monday coming)amd sort payment out. so hopefully it'll be sorted by monday. should I ignore the letter from red/lowell. I am not eligible for JSA as I live with my gf at her mothers house, wouldn't want my gf quit her job just to claim Joint JSA. and as it is my debt I wouldnt want my gf to pay on my behalf. I will keep you updated on monday and seek further advice or thank you for being helpful depending on the outcome
  • red DCA is a part of lowell so not another DCA just another name for the same company so its not been sold on again

    Don't phone them, write, ask for proof of the debt first of all, that will keep them busy a while, then, if you cant pay, just write and tell them, let them make you Bankrupt !! it will cost them £700 plus to do that, and the debt is only £500, you don't own a home, etc etc, do you see where im going here, a lot of it is just idle threats, they could go to court with it, but the court would not make you pay more than you could afford, even if its a £1 a month, more idle threats, really cant pay ? write and tell them that, what can they do ?
