I am due to leave my job on August 22 and am trying get some information. I am entitled to 28 days statutory holiday pay a year. My employer includes Bank Holidays in this holiday. When I leave does my employer have to include all 28 days when working out my entitlement, or do they only have to include the other 20 days that I can take voluntarily.

They have to include the full entitlement but will pro rata it for the part year.
There is a calculator on the gov website which will calculate part year entitlements:

Thank you. I understand that it will be pro rata. I was just struggling to find out if it was the whole 28 days or not.0

The calculator is not very accurate when working out entitlement part way through the year as it doesn't take into account holiday already taken but it will give you a good idea of what you have left. When does the holiday year run from- to? How much have will you have taken by your leave date?0

My leave year runs from Jan 1st to Dec 31.
I have taken 12 days holiday plus the 5 bank holidays so far this year.
What should I have left?0 -
From Jan 1st to Aug 22nd you will have worked 168 days, you don't accrue leave whilst on leave so 168-17 days taken so far leaves 151 days x12.07% = a total of 18.23 days accrued. 18.23 - 17 days taken so far (by Aug 22nd) leaves them owing you 1.2 days at that point.0
