Mortgage application put on hold

Options
Hi myself and my partner recently applied for a mortgage with TSB

It was all agreed in principle and a mortgage promise was issued.

We put an offer which was accepted in on a house and paid TSB the valuation fee and started proceedings with a solicitor.

After we had done all this our mortgage advisor called telling us it had been placed on hold and we had to check our credit files.

I know that I had a 5 year old default which is fully satisfied and will fall off next year she said this wasnt an issue.

However I hadn't checked my file for a couple of years and there was a stinker a CCJ from DWP for £500 issued in 2012 for an address i havent lived in since 2009 for benefit overpayments.

I instantly called up the issuing court and paid the amount in full on the day that I found out and I am applying to have it set aside as I never received any summons obviously as I hadn't been at the address for 3 years at that point.

I called the court again this morning and DWP haven't yet notified them that it has been paid.

I am taking in print outs of mine and my partners scores today upon request from the mortgage advisor which shows my partners 999 score and mine of 805 with 24+ months of on time payments on credit cards, current accounts, mobile contract & utility bills

How likely would you say that this will all go ahead? This has been stressing me out something rotten the entire weekend (we got told on wednesday) and as a first time buyer I feel incredibly dissapointed in myself to be letting my partner down in this way as it's something we have been saving for for years.

If anyone has any advice or slightly more relaxed lenders that would be fantastic.

Thanks in advance
Tony

Also a little further info. We have a 10% deposit and the house value is £96000 if that makes a difference.

You may struggle to have the CCJ set aside. As all the law requires is for the papers to be served at the last known address. Onus isn't on the claimant to track the debtor. For the obvious reason is that in the past (pre credit reference agencies) absconding was the way people avoided paying due debts.

Your mortgage advisor is the one best placed to advise you of your options.

I understand that but it is surely worth a try!

I saw the advisor at TSB again today and she seemed hopeful after viewing my entire credit file and the age of the issue and said that the underwriter is coming in on thursday to look at it in further detail and she will get in touch the same day.

Here's hoping the house doesn't slip away in the meantime!
