Hi, I tried to figure the answer to this out using other threads but I'm still a little confused so I was hoping for some help in advance so I can get it sorted as soon as I get the penalty charge.
I picked my friend up from JLA today on the roundabout. He was waiting there already so I barely even had to stop to allow him to get in, and I pulled away pretty fast as I realised the van I pulled up next to had a camera sign on it. Upon reading a few forum posts it seems likely I will get a penalty charge for this. Can I appeal this?
I found this forum post which seemed fairly relevant:

Do you think I could use this and amend the section about pulling up at the barrier and instead just highlight more heavily that I had stopped for less than 10 seconds where there was genuinely no other traffic and causing no obstruction?
I'm nervous of contesting it and having to pay more!

You won't be paying anything as we always win - haven't lost an Airport one, ever, in nearly 2 years since POPLA stated! Just use the template appeal shown in the top thread on the forum. Either use 'forum jump' (bottom right) to get there or click on the link mentioned in my signature under this reply. Then read the top thread. That's how everyone wins and the sticky thread (cunningly hidden at the top with the words 'read this first'!) includes your POPLA appeal wording (second stage) in post #3 of it as well.

The thing is with these airports tickets they can only go after the driver. If they do not know whom that person was they are !!!!!!ed.You never know how far you can go until you go too far.0

do not even mention or imply who was driving
once you get the NTK, appeal as RK using the template letter , and ensure you use a recent JLA popla appeal for popla
as JLA is not relevant land, POFA 2012 does not apply so they can only pursue the driver, which is why you do not mention what you did or who did it
stick to the standard RK appeals and if necessary let popla do the work, no trying to explain yourself and give the game away

Ok so I sent the soft appeal letter in the sticky thread to an email address on the PCN (no need for proof of posting etc) and got an automated response saying that they will be unable to process my appeal without the full postal address of the motorist.
Am I to just ignore this and assume they will process it anyway as I have already stated that I will not be giving them the name of the driver, and they already have the postal address of the keeper as they managed to send me the PCN?0 -
correct, ignore the incorrect auto response and it breaks the BPA CoP

Standard automated response. They don't need the motorist's name and address (whatever 'motorist' means in this context; it's more a trap for you to read it as the 'driver') as they are now pursuing the keeper.
I'd be minded to put in a complaint to the BPA (Steve Clark - email addy in section 6 of NEWBIES sticky) that they are asking for information they have no right to with such a condition as being unwilling to process your appeal without you divulging the name and address of 'motorist'.
Nowhere in PoFA 2012 or the BPA Code of Practice requires this.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
