Setting Off

I had a very old debt with barclays bank which I am confident was sold on to a DCA.

My question is - I have heard of people opening accounts with banks and there account has been emptied to pay off old debts to the same bank/banking group.

I have a new barclays account and wondered if its likely they will still take money from my account towards my old debt even though they have sold it on?

Ive struggled to get a basic account, and like this new barclays one as the debit card seems better than most (can pay at the petrol pump etc) Ive not yet had much money go in or out of this account, but ideally I would like to start having my salary paid in.

  • If Barclays have sold your debt on, then you no longer owe them any money, you owe the DCA instead. Barclays therefore can't take money from a different account with you in set-off against a non-existent debt.

    Was it sold, or just assigned ?
    You need to be sure,
    how long ago are we talking, and did you pay anything towards the debt at all ?
    If the debtor cant be traced, or doesn't pay, its not unheard of for debts to get passed back to original creditors.
    Could be a nasty surprise awaits you, have you any paperwork at all ?

    MMMMmmmmm gosh no I haven't - I was pretty sure it was a DCA that contacted me but heard nothing for a very long time - probably 8 years +

    I have recently checked my credit file with Noddle & Annual credit report and there's no sign of the debt on there.

    Is it worth mentioning to Barclay's? Although I don't really want to bring attention to the fact I have an outstanding debt with them

    No I certainly wouldn't mention it to them, after 8 years you will probably be ok, it would be statute barred by now, but they could still take the funds, as all SB does is prevent them getting a CCJ against you, they can still take any money owed from your account, I would say there records may not stretch that far back, but there is no guarantee.

    I asked this same question last week. After research I decided it wasn't worth the risk of opening an account with the bank I owed money to. The link could still be on their system somewhere. So opened an account with Nationwide.
    I have enough money to last me the rest of my life,as long as I die next Tuesday.
