Land Registry Alert Question.....

Question to all here - from a very confused Bunny......

Following various mortgages rants over on the mortgage & endowments board, I have had a Land Registry alert through that states that the lender have lodged an application today on the property that we are hoping to buy. However we have not yet had our Mortgage offer through?

I may have this wrong, but I thought the applications were lodged after exchange in readiness for completion?? At least I would not expect this to happen before offer??

Can any one shed any light on this??

    application for what?

    Why are you getting alerts from the LR? Are you doing your own conveyancing? Since you seem out of your depth, I sugest you seek legal advice.

    If however you are using a conveyancer, why are the alerts not going to him?

    Bluebunny - it sounds as if you have registered to use our Property Alert service

    As such you would receive an alert either when an official search or significant application is received against a monitored property. The service is primarily aimed at the actual owners to monitor their own properties but it can be used in other ways as well and against up to 10 registered titles

    In this instance I would suggest you have received an alert as an official search (OS1) has been lodged against the title to protect a loan/mortgage.

    An official search effectively checks whether any changes have been made to register since a given date and also locks down the title against most other registrations for 30 business days.

    It is normal conveyancing practice to complete such a search prior to lodgement of any actual application to register the purchase/new mortgage etc

    If you are unsure as to how the service works or what triggers an alert then follow the link as all the answers are there.

    The key thing is to check the alert details to see if they relate to the lender you are dealing with. If they do not then I would suggest contacting your solicitor to query what may be happening and they can raise with the seller.

    Thanks guys! it does relate to the lender I am using, I was just confused becasue we have not yet had our mortgage offer through yet, so I was surprised that this had been done before we had been accepted for the mortgage!!

    Does it cost anything to receive alerts from the Land Registry when you have put in an offer for a property?

    Property alert is a free service - follow the link above and it tells you all you need to know about the service
    I should stress that the service is designed to assist with reducing the risk of being a victim of property fraud rather than monitoring a property when you have put an offer in. However I can see there could be a link around risks as well
