Hello there,
In a nutshell, any agreement taken out after 6th April can never be deemed to be irredeemably unenforceable. That means that a court could allow for a credit agreement to be enforced regardless of what paperwork the claimant has or doesn't have.
For agreements taken out prior, it is still possible for agreements to be irredeemably unenforceable - for example if they are missing a key term or are unsigned by the debtor. There are a few other instances where an agreement could be irredeemably unenforceable too - but these are quite uncommon by comparison.
Hope this helps!
