    Arrears wouldn't be that much eg another 100%

    The CSA would not care a jot whether he had paid or not if there was no case open with them. When did he receive the MEF?
    I can only be there being arrears between the date of the letter to him and the current date (the normal advice is, once you receive MEF, stop paying the private agreement if there is a case that the ex would deny receiving and you would end up paying twice)
    Is he sure there was never a case open in the past (but they decided to handle through private agreement)

    If there has never been a CSA case then he cannot have CSA arrears even if he never paid 1p

    You have to come to terms with the harsh reality that the CSA believe EVERYTHING that the claimant states and NOTHING that the respondent says in return, irrespective of proof or evidence. As far as they are concerned the PWC is God and the NRP is something that you wipe onto the pavement from the bottom of your shoe - FACT.


    This is the first of many hurdles which you will encounter with this shambolic organisation which has ultimately driven many NRPs to suicide (and their employees still manage to sleep at night).


    I could inform you of many personal experiences that I have had with the CSA which would literally put hairs on your chest and quite frankly would be filed within the "fiction" section in the library if I was to publish it all without the supportive documentation to back up it's validity to appear in the "factual" section.


    Your "friend" must remain calm and try to relax as far as is possible but as an individual who has been forced against my will to be the victim of an AEO despite not being as much as a penny in arrears, I wish him luck.

    I'm not sure there is a gross injustice , the 'facts' are unclear, and it would seem to me that (a) the OP is mislead or (b) misunderstanding what the friend is saying is happening.
  • I think that the things that need to be confirmed are;
    a) When did the case originally open. Was it a couple of years ago, when he started paying maintenance, or was it earlier this year when his ex contacted the CSA to report missing payments? I know you said that he's been paying by private arrangement, but it could have been a CSA case set to maintenance direct, ie payments kept between the two clients.
    b) What contact has he had from the CSA? There are a certain number of letters that have to be issued before they can impose a Deduction From Earnings Order, how long have they been trying to get him to set up payments with them? It's very suspicious that they could already be at the stage where they've got a DEO in place to deduct his wages at the end of this month. Has he had letters and ignored them? He may want to get a copy of all paperwork relating to his case, this would include copies of letters and dates. I believe that this subject access request (SAR) is now free with the DWP, but don't hold me to that.
